TERMS AND CONDITIONS

The Diamond Resorts FRIENDS & FAMILY owner referral program is sponsored by Diamond Resorts Marketing, Inc., ('DRIM'). This program has been designed for members of THE Club® at Diamond Resorts in good standing (i.e. mortgage payments, maintenance fees and dues for THE Club® are current) and their qualified referrals, and is not valid with any other promotion program. You must be a member of THE Club® at Diamond Resorts to qualify for this program and utilize the points and/or credits awarded with this program. Maximum of twenty (20) referrals allowed per year (subject to individual state restrictions). The Diamond Resorts FRIENDS & FAMILY program, the available redemption rewards, and these Terms and Conditions are subject to change with or without notice.

The Diamond Resorts FRIENDS & FAMILY owner referral program is void where prohibited by law. Although no one is excluded from attending a sales presentation or purchasing a timeshare interest at a Diamond Resorts destination in THE Club® portfolio, to qualify for this program, referrals must meet certain qualifications as described below.

Participation in this program and receipt of rewards are limited to residents of states permitting owner referral rewards and may be restricted completely or in value as required by state law. All participants are prohibited from conducting or participating in any independent advertising or promotions to produce qualified referrals, and from negotiating or assisting in the negotiation of a vacation membership interest purchase. Due to variances in state regulations, if you reside in a state that prohibits referral programs, you may not be eligible for this program. Participants may be prohibited from providing vacation getaway package information to qualified referrals in certain states. Additional restrictions may apply in participant's state of residence. The following states have various owner referral restrictions: AK, AR, AZ, CO, CT, HI, ID, IL, KS, KY, LA, MA, MI, MO, MS, MT, NE, NH, NJ, ND, OH, OR, RI, VT, WA, WV and WY. Arkansas, Minnesota and Texas prohibit referral compensation dependent on a purchase. Minnesota has a $150 limit per referral. Texas and Utah limit rewards to $50. Arizona state timeshare law limits rewards to $600 in credit or non-monetary compensation during any 12 month period. Hawaii timeshare law limits annual rewards to 12 referrals and $1,000 in credit or non-monetary rewards and requires purchases within the Hawaii Collection. Illinois limits rewards to $1000 per year. New Jersey timeshare law permits non-monetary rewards. Ohio timeshare law limits rewards to $1,000 within 12 consecutive months. Qualified Referrals: A qualified referral is a referral who meets the following qualifications: 1) is personally known by you; 2) has not toured a Diamond Resorts destination in THE Club® portfolio in the past six (6) months; and 3) is gainfully employed, creditworthy, possesses a major international credit card and holds a valid state identification to apply for financing. If referral is a resident of a state where registration requirements have been met, referral must also meet the following requirements: 1) has a minimum combined household income of at least $60,000 (combined income of unmarried persons living together may be used to determine "household income"); 2) special income requirements apply for Hawaii where the combined income requirement is $75,000 annually; and 3) agree to attend a timeshare sales presentation during his/her stay.

To be considered a qualified referral of yours, you must personally know the referral and provide the following information: 1) current name, address, phone number and e-mail address (if applicable); 2) spouse's name (if applicable). All qualified referral contact information must be current and valid. Couples shall be considered as one referral. If there is a duplication of a qualified referral between two participants, the first participant to register the referral in the program will receive the referral credit. Individual referrals may not tour at the same resort more than once in any six-month period.

Only one referral may visit a resort location at a given time. Multiple referral reservations for the same property are prohibited. You will not be eligible for owner referral program rewards for referrals that purchase Sampler programs or resale products (third party sales). Participation in this program and submission of a qualified referral constitutes permission for DRIM and its affiliates to use your name when contacting your qualified referral(s). Additional qualifications apply for each specific owner referral program.

Owner Referral Programs: If permitted in your state of residence, you may be eligible to receive benefits for eligible qualified referrals who purchase a timeshare during a sales presentation at a Diamond Resorts destination in THE Club® portfolio.

Owner Referral Reward Payment: If eligible, and dependent upon the referral completing the purchasing process, reward payments may be made, where not prohibited by state restrictions, in the form of A) company check for a dollar value; or B) posted to the online account of a member of THE Club®; or C) electronically loaded onto a preauthorized Visa® gift card.

Qualified Referral Sale: If a qualified referral, submitted and registered by you, meets the qualifications of this program and purchases a timeshare interest during his/her/their initial sales presentation, you may be eligible to receive compensation of $500, $750 or $1000 if they purchase Points and become members of THE Club®. Subsequent purchases from qualified referrals do not entitle the referrer to additional rewards. If referrals have already toured or already purchased prior to the member referring them, then no rewards will be awarded for that referral. Unless restricted by state law, DRI owners are entitled to receive $500 for the first referral who purchases timeshare, $750 for the second referral who purchases timeshare and $1000 for each subsequent referral who purchases timeshare.
